Types of Marriage in Cambodia
Civil Marriage
The only legally recognized form of marriage in Cambodia. Registered at the Sangkat (commune) or Khan (district) office. This is the registration that creates legal rights and obligations between spouses — inheritance, shared property, spousal visa eligibility.
Religious Ceremony
Buddhist, Christian, and other religious ceremonies are culturally significant but are not legally binding on their own. A religious ceremony must be followed by civil registration at the commune office to create legal marriage status.

Documents Required for Foreigners

Spousal Visa & Residency in Cambodia
Marrying a Cambodian citizen does not automatically confer residency rights in Cambodia. There is no dedicated "spousal visa" category in Cambodia's visa system. Foreign spouses of Cambodian citizens should:
Maintain an EB (business) visa and apply for an annual stay permit extension. This is the standard long-term residency mechanism for most foreigners in Cambodia regardless of marital status.
Marriage to a Cambodian citizen opens the pathway to naturalization. After 3 years of marriage and lawful residence in Cambodia, you may apply for Cambodian citizenship. The process is discretionary — there is no automatic right. Our lawyers advise on naturalization applications.
Bringing a Cambodian spouse to your home country is governed entirely by your home country's immigration law, not Cambodian law. You must meet your home country's financial, relationship, and documentation requirements.

Marital assets (acquired during marriage) are divided equally between spouses. Pre-marital assets and inherited assets remain individual property. Complex asset situations require court determination.
Cambodian courts lean toward awarding primary custody to the mother for young children, particularly those under 5. Both parents retain parental rights. Best interests of the child is the legal standard.
