    Buying Real Estate in Cambodia as a Foreigner 2026: Strata Titles, Trust Structures & Risk-Free Legal Guidance

    Foreigners cannot own Cambodian land directly under the 1993 Constitution. But with the right legal structure — a Strata Title for condos or the 2019 Trust Law for land and houses — foreign buyers can achieve secure, legally enforceable property ownership.     The Legal Framework for Foreign Property Ownership

    Cambodia's 1993 Constitution prohibits non-Cambodians from owning land. However, successive legislation has created lawful pathways for foreigners to hold secure, enforceable property interests:

    • 2010 Co-ownership Law — permits foreigners to own condo units via Strata Title (max 70% foreign per building, above ground floor)
    • 2019 Trust Law — allows foreigners to hold beneficial ownership of land through a licensed Cambodian trustee, with 100% legal control retained by the foreigner
    • Long-term Leasehold — up to 99 years, registered with MLMUPC, fully transferable and legally binding

    Strata Title (Co-Owned Condo)

    Strongest Title

    Under the 2010 Co-ownership Law, foreigners can own condominium units via Strata Title — the strongest form of property ownership available to non-Cambodians. The title is in your name.

    • Available for units in buildings with a strata subdivision plan registered with MLMUPC
    • Foreign ownership capped at 70% of total units per building
    • Unit must be above ground floor (no ground-floor ownership for foreigners)
    • Full rights to sell, rent, mortgage, or transfer
    • Most new condo developments in Phnom Penh, Siem Reap, and Sihanoukville are strata-eligible

    2019 Trust Law (Land & Houses)

    Most Flexible

    Cambodia's 2019 Land Trust Law allows foreigners to hold beneficial ownership of land and landed properties through a licensed Cambodian trustee. You retain 100% legal control and economic benefit.

    • A licensed Cambodian trustee holds the hard title — you are the beneficial owner
    • You control 100% of decisions: sell, lease, develop, or transfer
    • Trust deeds are registered and legally enforceable
    • No foreign ownership cap — can apply to any property type
    • Most flexible structure for villas, land, and commercial property
    • Suitable for investment properties and family homes

    99-Year Leasehold

    Budget-Friendly

    Long-term leases registered with the Ministry of Land (MLMUPC) offer a practical alternative. A properly registered 99-year lease is legally binding and transferable.

    • Lease registered with MLMUPC provides strong legal protection
    • Can include options to purchase if/when laws change
    • Lower entry cost than trust structures
    • Fully transferable to heirs or third parties
    • Common structure for large land parcels and resort developments

    Understanding the 2019 Trust Law

    The 2019 Trust Law is a landmark piece of legislation that has transformed foreign investment in Cambodian real estate. Prior to 2019, foreigners had limited safe options for holding land or houses. Now, a registered trust structure provides a genuinely secure path.

    Under this structure, a licensed Cambodian trustee (a regulated entity, not just an individual) holds the Hard Title. As the beneficial owner, you sign a Trust Deed that gives you complete control: the right to sell, lease, develop, mortgage, or transfer the property to your heirs — with the trustee obligated to act on your instructions.

    The Trust Deed is notarized and registered with the Ministry of Economy and Finance (MEF) and the Ministry of Land Management (MLMUPC). This registration creates a public record of your beneficial interest, protecting you from trustee insolvency or changes in government policy.
